1. Scope and Who We Are

This Privacy Policy explains how KIWII AI INC. ("Kiwii," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit launch.kiwii.ai and related Kiwii product landing pages, join a waitlist, complete a survey, communicate with us, or interact with our advertising (collectively, the "Service").

KIWII AI INC. is a Delaware corporation. Privacy questions and requests may be sent to marketing@kiwii.ai or mailed to KIWII AI INC., 4521 Campus Drive, Ste 292, Irvine, CA 92612, United States.

The Service is intended for people located in the United States. If you access it from another country, your information may be transferred to and processed in the United States.

2. Personal Information We Collect

Information You Provide

  • Contact information. Your email address and any other information you include when you contact us.
  • Waitlist information. Your email address, landing-page segment, referral source, and information associated with your request for launch updates or early access.
  • Survey information. Voluntary responses about age range, gender, routines, activity level, product interests, wellness goals, purchase preferences, and free-text feedback.
  • Communications. Messages, requests, feedback, and records of our responses.

Information Collected Automatically

  • Device and network information. IP address, browser and device type, operating system, language, approximate location derived from IP address, and similar technical information.
  • Usage information. Pages viewed, links and buttons selected, referring page, timestamps, campaign parameters, click identifiers, and events such as PageView and Lead.
  • Cookies and similar technologies. Cookie identifiers, local storage, pixels, tags, and similar technologies used for site operation, measurement, fraud prevention, and advertising.
  • Advertising information. Information associated with our advertisements on Meta and, when enabled, Google, including ad interactions, attribution data, audience membership, and conversion events.

Wellness-Related Information

Some voluntary survey responses may reveal wellness interests or permit limited health-related inferences. We do not request medical records, diagnoses, medication histories, genetic information, or information for medical treatment. We do not use survey responses to make decisions about health care, insurance, employment, credit, housing, or access to essential services, and we do not upload individual survey answers to Meta or Google to create personalized advertising audiences.

3. Sources of Personal Information

We collect personal information directly from you, automatically from your browser or device, from advertising and analytics providers, and from service providers that help us operate the Service. We may also receive aggregate campaign information from Meta or Google concerning our own advertising accounts.

4. How We Use Personal Information

  • Operate, secure, troubleshoot, and improve the Service.
  • Manage waitlists and communicate about Kiwii product availability, pricing, testing, launch, and related updates.
  • Analyze survey responses and product interest to guide product and marketing decisions.
  • Measure advertising performance, attribute conversions, prevent duplicate event reporting, and create or manage advertising audiences as permitted by law and your choices.
  • Respond to questions, privacy requests, and support inquiries.
  • Detect fraud, abuse, security incidents, and violations of our Website Terms of Use.
  • Comply with law, enforce our rights, and establish or defend legal claims.

5. How We Disclose Personal Information

We disclose personal information only as reasonably necessary for the purposes described in this Policy, including to the following categories of recipients:

  • Hosting and infrastructure providers. Vercel and providers that host or secure the Service.
  • Email and waitlist providers. Klaviyo and related providers that manage subscriptions, lists, and email delivery.
  • Productivity and data-storage providers. Google Workspace, Google Sheets, Google Apps Script, and related tools used to receive and store waitlist or survey information.
  • Advertising and measurement partners. Meta Platforms and, when enabled, Google Ads or Google Analytics, for advertising delivery, attribution, conversion measurement, audience management, and campaign reporting.
  • Professional advisers. Lawyers, accountants, auditors, insurers, and consultants subject to appropriate confidentiality obligations.
  • Authorities and legal recipients. Government agencies, courts, counterparties, or others when required by law or reasonably necessary to protect rights and safety.
  • Corporate transaction recipients. Parties involved in a financing, merger, acquisition, reorganization, bankruptcy, or sale of assets, subject to appropriate safeguards.

6. Sale, Sharing, and Targeted Advertising

We do not sell personal information for money. When advertising technologies are active, our disclosure of identifiers and internet or device activity to Meta or Google for cross-context behavioral advertising, audience creation, or targeted advertising may be considered a "sale," "sharing," or processing for "targeted advertising" under certain U.S. state privacy laws, even when no money is exchanged.

You may opt out by selecting Privacy Choices in the footer of the Service and changing your advertising privacy choices. We will also treat a legally valid Global Privacy Control signal as a request to opt out where required. We do not require you to create an account to submit an opt-out request.

We do not knowingly sell or share personal information of anyone under 18 for targeted advertising.

7. Cookies and Advertising Choices

We use necessary technologies to operate and secure the Service. Depending on our active campaigns and your choices, we also use or may use Meta Pixel, Meta Conversions API, Google tag, Google Ads conversion tracking, Google Analytics, and similar technologies.

  • Meta. Meta tools may receive device information, page activity, campaign identifiers, and conversion events. Meta advertising preferences do not replace the choices we provide on our Service.
  • Google. When enabled, Google tools may receive device information, page activity, campaign identifiers, consent status, and conversion events. We will not enable enhanced conversions or Customer Match unless our disclosures, consent or opt-out controls, and operational processes support that use.
  • Browser controls. You may block or delete cookies through your browser, although parts of the Service may not function as intended.
  • Global Privacy Control. Where required, we recognize GPC as an opt-out of sale, sharing, or targeted advertising.
  • Do Not Track. Because there is no uniform industry standard for browser Do Not Track signals, we do not currently respond to DNT signals other than legally recognized opt-out preference signals such as GPC.

8. Marketing Communications

You may unsubscribe from marketing emails at any time by using the unsubscribe link in an email or contacting marketing@kiwii.ai. We may still send non-marketing messages necessary to respond to your request or administer your privacy choices.

9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy. In determining retention periods, we consider the duration of the waitlist and product-research cycle, whether you remain subscribed or engaged, contractual and legal requirements, security and fraud-prevention needs, and the time needed to establish or defend legal claims. We delete or de-identify information when it is no longer reasonably necessary, subject to backup cycles and legal exceptions.

10. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Your Privacy Rights

Depending on where you live and applicable law, you may have the right to request access, correction, deletion, or a portable copy of personal information; obtain information about categories of third parties; opt out of sale, sharing, targeted advertising, or certain profiling; limit certain uses of sensitive personal information; withdraw consent; and appeal a decision concerning a privacy request. You will not be unlawfully discriminated against for exercising a privacy right.

Submit a request to marketing@kiwii.ai with the subject "Privacy Request." You may also use the privacy-choice link in the footer for advertising opt-outs. We may need to verify your request using information reasonably related to our records. Authorized agents may submit requests where permitted by law. We generally respond within 45 days when a state privacy law requires that timeframe.

12. California Notice

For California residents, the categories of personal information described in Section 2 are collected for the business and commercial purposes described in Section 4 and disclosed to the recipient categories described in Section 5. During the preceding 12 months, we may have disclosed identifiers and internet or device activity to advertising partners in ways that could be considered sharing for cross-context behavioral advertising. We do not sell personal information for money.

If the California Consumer Privacy Act applies to us, California residents may exercise applicable rights to know, access, correct, delete, opt out of sale or sharing, limit certain uses of sensitive personal information, and receive equal service. Regardless of whether the CCPA currently applies to us, we provide the advertising opt-out described in Section 6. California residents may also request information concerning certain disclosures for third parties' direct marketing purposes by contacting marketing@kiwii.ai.

13. Children's Privacy

The Service is intended for adults and is not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided personal information, contact us so we can take appropriate action.

14. Third-Party Services

The Service may link to third-party websites or services. Their privacy practices are governed by their own policies, and we are not responsible for their practices.

15. Changes to This Policy

We may update this Policy from time to time. We will post the revised version and update the effective or last-updated date. If required by law, we will provide additional notice or obtain consent before a material change takes effect.
